Constitutional Court Grants Lawsuit Over Chief's Term of Office

The Constitutional Court (MK) partially granted a judicial review of the constitutional judge's term of office in Law No.7/2020 on the Constitutional Court. This decision requires the Chief Justice of the Constitutional Court, Anwar Usman, to resign from his current position. "Granting the Petitioner's request partially," Anwar said when reading the court's verdict on Monday.

In his decision, the Constitutional Court judge stated that Article 87a of Law No. 7/2020 was contrary to the 1945 Constitution. The article stipulates that a constitutional judge can hold the Chief Justice of the Constitutional Court until his term as a judge ends. After this decision takes effect, Anwar Usman and Deputy Chief Justice of the Constitutional Court Aswanto must resign from their positions, but their status remains as constitutional judges. Anwar Usman's term as a constitutional judge ends on April 6, 2026, while Aswanto will serve until March 21, 2029.
