Government Relaxes Mining Regulation

Summary

Mineral and coal mining companies in Indonesia can now submit an early revision of mineral and coal program and budget (RKAB). The government allows them to file the change in the first-quarter financial statements instead of half-year financial statements through the Energy and Mineral Resources Ministerial Regulation (Permen ESDM) No. 7/2020 on the procedure of land grant, permit, and the report of mineral and coal mining business.

The regulation, issued on March 3, states that the mining company’s revision on mineral and coal program and budget is no longer limited on the change of capacity, as stated in the previous Energy and Mineral Resources Ministerial Regulation No. 11/2018. Moreover, in a case of emergency, or a condition that impedes environmental support, mining companies can file the revision more than once. Hopefully, the regulation can accommodate the slowdown in the mineral and coal mining business affected by the Covid-19 pandemic.
