Labor Unions File New Lawsuit Against Perppu of Job Creation Law

labor law
Summary

Thirteen labor unions filed a formal constitutional review to the Constitutional Court against Government Regulation in Lieu of Law (Perppu) No. 2/2022 on Job Creation. The applicant's lawyer Denny Indrayana said the filing went on without waiting for the approval or rejection of the House of Representatives (DPR).

According to Denny, the lawsuit is filed partly because the issuance of the Job Creation Perppu violates the Constitutional Court's verdict on Law No.11/2020. He said the applicant should have submitted a judicial review of the Job Creation Perppu because the procedure for issuing the Perppu violated the requirements for forming good regulations. "The issuance does not meet the constitutional requirements of a compelling urgency," Denny said on Wednesday.
