Asabri Case Defendant Faces Death Penalty

Public prosecutors charged Heru Hidayat, a defendant in PT Asuransi Angkatan Bersenjata Indonesia (Asabri), with the death penalty in a trial taking place at the Jakarta Corruption Court on December 6. They stated that Heru, the President Commissioner of PT Trada Alam Mineral, was proven guilty of graft and money laundering that cost the state up to Rp 22.7 trillion. Repeated offenses and the massive amount of state losses were among the aggravating factors. Previously, Heru was sentenced to life in prison for his involvement in the PT Asuransi Jiwasraya case caused Rp 16.8 trillion in state losses.

Meanwhile, Kresna Hutauruk, Heru Hidayat's lawyer, revealed that he had filed a protest because the charge was invalid. According to Kresna, the prosecutors omitted an article that allows for the death penalty in his indictment. They charged Heru Hidayat with Article 2 Paragraph (1) and Article 3 of the Corruption Law and Article 3 and 4 of the Law on Money Laundering. "There is no death penalty. How could the prosecutors charge Heru using articles unrelated to the indictment?" Kresna elaborated on Tuesday.
