Constitutional Court Rejects Mineral and Coal Law's Lawsuit

The Constitutional Court (MK) rejected a proposal for formal review on Mineral and Coal Mining (Minerba) Law No. 3/2020, which revised Law No. 4/2009. "In the main point of the petition, the petitioners reject in its entirety," Constitutional Court Chief Judge Anwar Usman said on Wednesday.

The Judges Court considered that the applicant's argument regarding the passing of Minerba Law did not meet the requirements for a decision-making quorum in the House of Representatives (DPR) Plenary Session. The applicant reasoned that the House showed no transparency during the Law preparation. However, the judge did not find any convincing evidence that there had been a violation of the transparency principle in Minerba Law preparation. "The government and the House have proven that socialization and public discussions have been carried out during the talks," Constitutional Court Justice Enny Nurbaningsih said.
